How to protect our intimacy in the Network
We are in the age of the information, and as it offers multiple advantages, also it bears many disadvantages at the time of protecting our most personal ambience. We must know what information can be published and under that situations our right is infringed to the intimacy.
The Spanish Agency of Protection of Information (AEPD) it makes clear: "No citizen, either that or use of the condition of public personage is not even an object de facto of public relevancy, has to resign himself that his personal information circulates for the Network. He will always have right to ask for the cancellation”.
If our personal information appears on a page in which we do not want that they are published, although they should have obtained them of legal form, we will have to answer of the following form:
The first thing will be to locate the owner of the page. If it is a question of a Spanish page with domain ".es" we will gain access to his Politics of privacy, legal Notice or in the public Red.es organism to find this fact. In case of the foreign webs, in the domains base www.whois.com we will find a searcher in whom, introducing the information of access of the page in question, we will be able to know the name of his holder or owner. Being this base in English, his intuitive handling does that it is simple to use.
Once located, we will ask in writing this person or company “to withdraw from immediate form this comment or image that damages our fundamental rights”. If to 15 days they have not answered satisfactorily with the request, the following step in case of Spain would be to proceed by means of a denunciation across the Brigade of Technological Investigation of the National Body of Police officer, of the Group of Telematic Crimes of the Civil Guard or of the same AEPD, presenting the maximum information and evidences of this illicit treatment of our information.
If our right to the intimacy is not being damaged legally but we want that this information disappears, as soon as the two weeks was spent, we will be able to request a “procedure of tutelage of rights” to the AEPD so that these contents move back.
In case of the forums, he advises himself to do a request straight to the moderator so that it withdraws the comments of the user in which our information appears.
The only persons qualified to limit our personal information that appears in Internet we are we. To assure this right to us to the intimacy we must proceed on this matter, denouncing ultimately before the special organisms created with these ends.
