Although constitutionally it is valid, the Supreme Decree 072, which he authorizes to the mine-layer Newmont to acquire rights on the Peruvian-Ecuadoran border, is insufficient because it needs of a law, told the constitutionalist César Valega.

The attorney told that, according to the Great Letter, the investment deprived in areas of border of Peru is allowed only if one declares of public need the area, and although in this case he has declared himself, the ideal thing the dation of a law is and not only of a supreme decree.

“What has been done from the Fujimori government has been to give a Supreme Decree and nothing more, but the exceptional character that establishes the Constitution forces that is for law”, it stood out.

The foreign companies that have authorizations on border are Newcrest Resources INC and to the mine-layer Gold Fields Peru S.A. Newmont Peru SRL, EMP MIN LOS QUENUELES, Xiamen Zijin Tongguan, Solex of Peru, Sheridan Platinum Group, and Rio Tinto Mining and Exploration Limitited Peru.
